Terms of Service

These terms are between you and Twenty Labs Co. Ltd ("we", "us"), who make Moment Capture ("Moment"). By using Moment you agree to them. How we handle your data is in the Privacy Policy.

Who we are

Who can use Moment

• You must be at least 13 years old.
• If you are under 16, you may use Moment with an account only with the consent of a parent or guardian (Decree 13/2023/ND-CP of Vietnam). By signing in, you confirm you have it.
• If you believe a child has signed in without consent, contact us and we will delete the account.

Your account

Moment works without an account. Signing in with Apple or Google is optional and is needed for backup and shared boxes. Keep your sign-in secure; you are responsible for what happens under your account.

Your photos and our licence

Your photos are yours. To run Moment, you give us a limited, non-exclusive, worldwide licence to store, copy (for example into the Standard JPEG copy of a shared photo) and show your photos, your display name and your profile picture to the members of the shared box you added them to, and to back them up to your own account. We use this licence only to provide Moment. It ends when the photo or your account is deleted, except for copies members already saved, which we cannot take back, and routine provider backups that expire within about a week.

Shared boxes

A shared box is a box you make with other people. You are responsible for what you add to it.

• Only add photos you have the right to share, and that the people in them would not object to.
• Do not add anything illegal, sexual, violent, hateful or harassing, or anything that exposes or endangers a child.
• Do not use a shared box to harass, impersonate or threaten anyone.

We have zero tolerance for objectionable content and abusive behaviour. Reported content is reviewed within 24 hours and removed when it breaks these rules, and accounts that break them are banned.

Reporting and blocking

• Report: open the "..." menu on a photo, or a row in the member list, and choose Report. Tell us why in a few words.
• Block: choose Block on a person. Their photos disappear for you in every box at once, and you can unblock them later.
• You can also email [email protected].

Leaving and deleting

You can leave a shared box any time; photos you added stay in the box for the group. You can delete a photo, or your whole account, in the app (Settings, then Profile, then Delete account). Account deletion is completed after 30 days, as the Privacy Policy describes.

Suspension and termination

We may remove content, suspend or ban an account, or end access to Moment if you break these terms, break the law, or put others at risk. You may stop using Moment and delete your account at any time.

No warranty

Moment is provided "as is" and "as available". We do not promise that it will be free of errors or interruptions, or that backups and shared boxes will never lose data. Keep your own copy of photos you cannot lose.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost data or lost profits, or for what other users add to a shared box. Our total liability for any claim about Moment is limited to the amount you paid us for it in the previous 12 months (Moment is free to use, so this may be zero). Nothing here limits liability that cannot be limited by law.

Changes

We may update these terms. The new version will be posted at https://momentcapture.me/terms with a new effective date, and we will tell you in the app if a change matters to your use. Continuing to use Moment after a change means you accept it.

Governing law and disputes

These terms are governed by the law of Vietnam. Disputes that cannot be settled by talking to us first go to the courts of Ho Chi Minh City, Vietnam.
